Confirm trademark standing before you upload or sell.
Walk through these four steps in order. Each one is a checkbox; refresh the page and your progress stays. Finish all four and you are ready to ship a properly protected line.
An LLC or DBA does not protect your logo.
- 01Step 1Confirm you created the logo yourself, or you have an explicit license to use it on merchandise. If you do not own the rights to the mark, do not upload or sell merch with it — regardless of whether you have an LLC or have filed anything with the USPTO. No rights equals no merch.
- 02Step 2
Class 25 — Clothing. Covers the apparel itself: tees, hoodies, sweatshirts, caps, and other wearable goods. A Class 25 registration protects the mark as it appears on the product.
Class 35 — Retail services. Covers the storefront and the online shop: retail store services, online retail, and brand presence services. A standalone store on its own domain lands here. Filing both classes closes the gap end-to-end so neither the shirt nor the shop falls through.
- 03Step 3
Forming an LLC (Limited Liability Company) registers the business entity with your state. Registering a DBA (“doing business as”) registers the trade name at the local or state level. Neither one registers your logo or slogan with the United States Patent and Trademark Office.
LLC ≠ trademark
Forming an LLC or registering a DBA does NOT protect your logo or slogan. Federal trademark registration with the USPTO is what protects the mark. Verify this before you upload or sell. - 04Step 4
Before you file, run a clearance search in the USPTO’s Trademark Electronic Search System (TESS). A similar mark in either class can block your filing or trigger an opposition proceeding — so this step belongs in front of every upload and every launch.
